Sales Agreement

ACCEPTANCE OF TERMS
EarnAsYouGive.com ("the Website") is owned and managed by EAYG Enterprise ("Company" or "We" or "Us"). Only registered members of EarnAsYouGive.com may carry out a purchase of items (or "Products") from the Website. Your rights to purchase any items from EarnAsYouGive.com is subject exclusively to this Agreement. By proceeding with the purchase of any items from this Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept this Agreement, you must not proceed with your purchase.
PARTIES
This agreement ("Agreement") is between you ("Purchaser") and EAYG Enterprise ("Seller").
LEGAL ELIGIBILITY
The Purchaser warrants that he or she is over 18 years of age, not subject to the Child Online Privacy Act and of legal age to enter into contractual agreements as permitted by the jurisdiction of the State at which the Purchaser is located at the time of the Purchase. of the location in the Purchaser's present location at the time of purchase.
PAYMENTS
Payments for the purchase of items from EarnAsYouGive.com are handled by Authorised and Regulated Third Party Service Providers, currently offered by STRIPE (www.STRIPE.com), APPLEPAY, ALIPAY, and PAYLAH! Member must fulfil the requirements by these third party service providers in order to complete the sales.
FRAUDULENT PAYMENTS
The Seller takes a serious view on fraudulence. The Purchaser warrants that he/she is the true and authorized owner of the payment means used to make a purchase. If the Purchaser attempts to commit fraud upon the Seller, the Purchaser authorises the Seller to take the necessary steps to discover all relevant information about the Purchaser's fraudulent activities from any source including but not limited to credit bureaus and financial institutions, and to reveal such information to law enforcement agencies.
REFUNDS
All sales are final. The Seller does not provide any refunds for any items purchased from the Website. All items on sale by the Website are non-tangible irrevocable software in nature, such as ebooks, digital photographs and IT applications. The Website has implemented an Instant Payment Notification system which would allow the Purchaser to immediately download the newly purchased item upon completion of the sales. In the spirit of good faith, the Seller reserves the right to provide refunds on case-by-case basis where the Seller deems reasonable.
WHAT YOU CAN DO WITH YOUR NEWLY PURCHASED ITEM?
Upon the completion of sales, the newly purchased item will be listed in the "Cabinet" section of the member's portal of the Website. The Purchaser can do two things with the item:
1. Keep for personal use
  If the Purchaser decides to keep the item for personal use, the item will be available for download. Once, the choice is made, the item can no longer be sent to someone else as a gift.
2. Send the item to someone as a gift
  If the Purchaser decides to send the item to someone, the Purchaser will not be able to download the item. The recipient has the option to accept or reject the gift. If the gift is rejected, the Purchaser wil have the option to decide what to do with it again. If the gift is accepted, the Purchaser will no longer be able to download the item for personal use. The recipient of the gift will have to register as a member of the Website in order to accept and download the gift.
DOWNLOADING OF PURCHASED ITEM
1. Accessing the items for download: Upon the completion of sales, the items purchased are immediately available for download by the Purchaser or, by the recipient of the item given by the Purchaser. The items for downloading can be found within the "Cabinet" section of the Website member's portal.
2. Expiry of Download: Every newly purchased item are available for download for the next 30 calendar days starting on the day that the sales is completed. The time zone is based on Singapore time (GMT+08:00). After the 30 days, the item will no longer be available in the member's "Cabinet" or the gift recipient's Cabinet.

PRODUCTS PURCHASED FROM THE WEBSITE ARE PROVIDED, AS IS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE SELLER DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE USE, OR THE RESULTS OF THE USE, OF THE PRODUCTS OR WRITTEN MATERIALS IN THE TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CURRENTNESS OR OTHERWISE. THE ENTIRE RISK, AS TO THE RESULTS AND PERFORMANCE OF THE PRODUCTS PURCHASED ARE ASSUMED BY YOU. IN NO EVENT WILL THE SELLER BE RESPONSBILE FOR DAMAGES OF ANY NATURE WHATSOVER RESULTING FROM THE USE OF OR RELIANCE UPON THE PURCHASED PRODUCTS.
INDEMNITY
You agree to indemnify and hold the Seller and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against the Company arising out of any breach by you of this Agreement or other liabilities arising out of your purchase of any item(s) from this Website.
SEVERANCE
If any specific part of this Agreement should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, then the affected part of the Agreement shall be severed and the remaining Agreement shall survive and remain in full force and effect and continue to be binding and enforceable.
GOVERNING LAW
This Sales & Purchase Agreement shall be governed by and construed in accordance with the law of Singapore and you hereby submit to the exclusive jurisdiction of the Singapore courts.
